This Privacy Policy sets forth terms and conditions for the processing and securing of personal data that are provided by the users and are used to deliver services through the IngramMicro24 website, domain www.IngramMicro24.com or other domains administered by Ingram Micro Sp. z o.o. seated in Warsaw (hereinafter: “Website”).

Whenever this Policy refers to the “Services”, these shall mean services provided through the Website, including the use of web account available through the Website, as well as training courses, lotteries, and other similar actions organized by the Website users. Regulations that govern the use of particular Services and are contained in the terms and conditions applicable to such Services can set forth separate rules for the processing of personal data.

§ 1.

Definitons

Data controller of users’ personal data provided in connection with the use of Services (hereinafter: “Data Controller”) – Ingram Micro Sp. z o.o., a limited liability company with its registered office in Warsaw at the following address: 02-255 Warszawa, ul. Krakowiaków 46; entered into the Company Register of the National Court Register kept by the District Court for the Capital City of Warsaw in Warsaw, 13th Commercial Division of the National Court Register, under number: KRS 0000028820, with its share capital of PLN 4,920,000.00 PLN, holder of (NIP) Taxpayer Reference Number: 521-29-31-906 and (REGON) National Business Registry Number: 013196912, which provides electronically supplied services, and stores and gains access to information about the Users.

IngramMicro24 – an IT system (website), accessible through the WWW interface, used to pursue cooperation between SUPPLIERS and business partners, maintained in the domain www.IngramMicro24.com by the Data Controller.

USER – a natural person who runs their own proprietorship, or a person who, as part of their official duties, represents a legal entity, or organizational unit without legal capacity that conducts business operations, that is a business partner of any of the SUPPLIERS and uses services provided through the IngramMicro24 website by the SUPPLIERS.

SUPPLIER - Ingram Micro sp. z o.o., a company organized under the laws of Poland, with its registered office in Warsaw, Ingram Micro Czech Republic s.r.o, a company organized under the laws of the Czech Republic, with its registered office in Hradec Kralove; Ingram Micro Magyarország Kft., a company organized under the laws of Hungary, with its registered office in Budapest; Ingram Micro d.o.o., a company organized under the laws of Serbia, with its registered office in Belgrade; Ingram Micro Ljubljana, tehnoloske resitve, d.o.o., a company organized under the laws of Slovenia, with its registered office in Ljubljana; INGRAM MICRO DISTRIBUTION SRL, a company organized under the laws of Romania, with its registered office in Bucharest; INGRAM MICRO D.O.O., a company organized under the laws of Croatia, with its registered office in Zagreb,a company organized under the laws of Macedonia Ingram Micro Macedonia DOOEL Skopje with its registered office in Skopje,

Changing the name of the SUPPLIER and the Administrator and / or its legal form does not constitute a change to the Privacy policy for the website.

§ 2.

INFORMATION AND DATA ASSOCIATED WITH WEBSITE CONTENT BROWSING

  1. The Data Controller processes data for the purpose of providing Services and marketing the Suppliers’ services and goods, and for other legitimate purposes.
  2. To the extent reasonable for any particular Service, the Administrator acquires the following data of the User:
    • name
    • identity document number
    • work phone number
    • e-mail address
  3. Also, the Data Controller acquires information about the Users and their behaviour through:
    1. information voluntarily entered in forms.
    2. cookie files stored on end devices.
    3. collection of web server logs by the Data Controller at www.IngramMicro24.com
  4. The Data Controller collects information provided voluntarily by the User.
  5. Moreover, the Website can store connection information (time-stamps, IP address).
  6. Data provided in the form are not made accessible to any third parties unless there is a relevant consent from the User.
  7. Data provided in the form can constitute a collection that is registered by the Data Controller in the register maintained by the Inspector General for the Protection of Personal Data.
  8. Data provided in the form are processed for the purpose of commercial communication or other communication being part of the Services offered through the IngramMicro24.
  9. The following can be stored:
    1. request time;
    2. response time;
    3. client terminal name – identified by the HTTP protocol;
    4. information about errors that have occurred while implementing a HTTP transaction;
    5. URL of the page previously visited by the user (referer link) – where the Website was accessed via a referral link;
    6. information about the user’s browser;
    7. IP address information.
  10. The data above are used to administer the server.
  11. The data are only made accessible to third parties to the extent permitted by law.
  12. The accessibility of the data that allow identification of a natural person are subject to a relevant consent from such person, except data the Data Controller is required to disclose by or under law.
  13. A connection between the USER and a server is SSL-encrypted and certified with the SSL certificate by the Authorised Certification Centre; such certification process uses mechanisms that exists in a contemporary web browsers, thereby excluding any third party access to the data transmission process, unless the USER permits such access, either deliberately or otherwise through incorrect execution of operations on, inadequate security measures for the USER’s computer.
  14. Data are stored on physical disks.
  15. Passwords are stored in hashed form and nobody but the USER can access them. To verify the password, the stored hash is compared against the password presented by the User.
  16. Data on the server are secured against any unauthorised access using IT technologies, and can only be accessed by:
    1. IT administrators of the Data Controller, through their direct access to data stored on server data matrices, or through the website administration panel.
    2. Operators of the Company and Suppliers, through the website administration panel.

§ 3.

COOKIE FILES.

  1. The Website uses cookie files.
  2. Cookie files are IT data, mainly text files, stored on the IngramMicro24 User’s end device, allowing the User to use the IngramMicro24 website. A cookie file typically contains the name of the website the cookie was sent from, lifetime of the cookie stored on the end device, and a unique number.
  3. Cookie files are placed on the IngramMicro24 User’s end device and accessed by the Data Controller.
  4. The Website uses two basic types of cookies: session cookies and persistent cookies. Session cookies are temporary files that are stored on the User’s end devices until the software (web browser) is turned off. Permanent cookies are stored on the User’s end device for as long as specified in cookie file parameters or until they are deleted by the User. Cookies do not contain any personal data or confidential information downloaded from the User’s device.
  5. Software for browsing the web (web browser) usually allows storing cookies on the User’s end device by default. IngramMicro24 Users can change relevant cookie settings. A web browser allows cookie files to be deleted. Cookies can be automatically blocked. For details, the help section, or documentation of the browser should be consulted.
  6. The User can restrict or disable access from cookie files to the User’s devices. However, restricting cookie files can affect some functionalities available from the IngramMicro24 website. If cookies are restricted, the Website can still be used except functionalities for which cookies are inherently required.
  7. Used by the Data Controller, the cookies are safe for the User’s device. In particular, no such cookies can spread viruses or other unwanted or malicious software into the Users’ devices. Cookie files allow identification of the software used by the User, and adaptation of IngramMicro24 to individual preferences of every User.
  8. The Data Controller uses Own Cookies for the following purposes:

      • recognition of the website User’s device and its location, and display of the website as tailored to the User’s individual needs;
      • font size, website appearance
    2. Completion of processes required for web pages to be fully functional

§ 4.

User’s rights.

  1. The User has the right to access the User’s personal data and make amendments and updates.
  2. The Data Controller ensures the deletion of the User’s data from the Collection of Data upon the User’s request as well as in other cases, pursuant to applicable laws.
  3. The Website user can contact the Data Controller at any time to obtain information whether and, if so, how the Data Controller uses or intends to use the User’s personal data.
  4. The Website User can also request the Data Controller to delete the User’s personal details in whole or in part.

§ 5.

Transfer and disclosure of personal data.

  1. The use of some Services can entail the accessibility or transfer of the User’s data to other Website users or outside the Website. If such accessibility or transfer results in personal data being forwarded to any other data controller, the processing of such personal data will be subject to the privacy policy adopted by such other data collector.
  2. The Data Controller can transfer the personal data to, or share them with third parties if:
    1. there is a relevant consent from the User; or
    2. it is justified by law; or
    3. it is necessary to provide Services
  3. In the above-mentioned cases, personal data can also be transferred outside the EEA, including the United States of America.
